Sony, GeoHot Settle PS3 Hacking Case

Sony and GeoHot have officially settled their differences. A notice on the PlayStation Blog notes that Sony Computer Entertainment America and George Hotz have reached a settlement in the case. No monetary terms were mentioned.

In the statement, GeoHot says that he never intended to make piracy easier, and that he’s happy that this whole episode is behind him.

SCEA says much the same, while at the same time saying its motivation for the legal action was to “protect [its] intellectual property and [its] consumers.”

And thus we close the door on this sad chapter in history

If this is true then it is almost a WIN for Sony! Reports are coming that PlayStation 3 hacker George Hotz (aka Geohot) has run away to South America from his New Jersey home in an attempt to escape Sony over hacking their game console. The hacker also lied about under oath having a PlayStation Network (PSN) account during legal proceedings with the company. Even the popular legal website Groklaw mentioned the possibility of GeoHot having a PSN account.

An official document (found here) filed by Sony from the Sony Computer Entertainment America LLC v. Hotz case recently detailed Hot’z recent actions. It said:

Though the evidence establishing personal jurisdiction is already overwhelming, SCEA has little doubt that there is much more. However, over the last several weeks. Hotz has engaged in a campaign to thwart jurisdictional discovery at every turn -regardless of whether the Court has ordered such discovery or not. Most seriously, after Magistrate Judge Spero ordered an inspection of Hotz’s devices and ordered Hotz to appear at a deposition in California, SCEA learned that Hotz had deliberately removed integral components of his impounded hard drives prior to delivering them to a third party neutral and that Hotz is now in South America, an excuse for why he will not immediately provide the components of his hard drives as requested by the neutral. Hotz’s attempts to dodge this Court’s authority raise very serious questions.

Additionally, Sony said:

When SCEA echoed TIG’s request that the components of the hard drives be delivered immediately, Hotz’s counsel responded that Hotz was in South America.

The hacker also lied about having a PSN account under the oath:

On January 12, 2011, Hotz submitted a declaration to the Court (Docket No. 19-1) in which he made unequivocal statements on a number of topics. However, when it came to discussing the PSN account, Hotz equivocated, stating: “To the best of my knowledge and belief, I do not have a PlayStation Network account.” Hotz also provided interrogatory responses that he has refused to verify, stating that he has not accessed the PSN. Bricker Decl. 4.Hotz identified four PS3 Systems in his possession. Bricker Decl., 4, Exh. C. He explained that he had purchased one of these consoles new in February 2010 and provided the serial number for that console. Id.SCEA used that serial number to determine that on February 25, 2010, Hotz purchased the PS3 System at a Gamestop store just miles from his home. Law Decl., 6; Bricker Decl., 6, Exh. E. SCEA’s records show that the same PS3 System was used on March 10, 2010 to create a PSN account under the user name “blickmanic.” Law Decl., 6, Exh. A. The IP address associated with the registration is located in Glen Rock, New Jersey, where Hotz lives.

Then, more evidence regarding his PSN account was discovered:

Hotz’s ownership of the “blickmanic” account is further supported by the fact that an Internet search of the user name “blickmanic” reveals a posting discussing the jailbreaking of cellular phones – Hotz’s original “claim to fame.” Bricker Decl., 7, Exh. F (“Just curious what people would pay for exclusive rights to this solution. [Motorola] Tracfone W175g unlocked and debranded. PM me.”) As discussed above, to create his PSN account, Hotz was required to first agree to the terms of the PSN User Agreement and thus he is clearly subject to personal jurisdiction in California. It is well established that a valid and enforceable forum selection clause operates as consent to personal jurisdiction in a designated forum.

Sony continued that even without his PSN account breach evidence, they already have enough evidence against him:

Although Hotz’s PSN account registration clearly establishes jurisdiction, even without it, SCEA has shown the necessary minimum contacts between Hotz and California.

Geohot Has Left The Country

It appears (according to court documents) that George Hotz, AKA Geohot, PS3 and iPhone hacker extraordinaire, has been hounded out of the country by Sony’s intense legal proceedings. Just a short while after a federal judge granted Sony unfettered access to Hotz’s IP logs and PayPal records (on a question of jurisdiction, I might add), Sony alleges that the kid has fled the country, heading for South America.

This comes on the heels of the latest document from Sony requesting trial in California, an obtusely reasoned exercise in legal sleight-of-hand, designed to browbeat Judge Spero into acquiescence. Hey, it worked for the last couple things they wanted. The latest letter to the judge describes how Hotz, despite denying it, did in fact create a PSN account. The evidence on that front is unassailable: he bought a new PS3 down the street and registered an account under his old forum handle, “blickmaniac.” Why he would lie about it is beyond me; I would have said that I agreed to the terms, and subsequently found the contract against my interests, and abandoned it — it seems that the penalty for breaking EULAs is more or less a loss of your “privilege” of running software covered by that license, and companies seem to choose not to enforce that.

It’s not said exactly that Hotz has gone to South America to escape trial, but that’s a pretty inescapable conclusion given the pressure on him right now. Somehow I doubt that was done on official legal advice. But perhaps he can lay low until this suit is successfully contested without his presence. Or maybe he’s just there for spring break?

Even Geohot himself warned on his blog that Sony might not get the right programmers in future. Perhaps the Japanese company seems to be struggling to get talent in this sector now.

But talented developers are in much shorter supply, and take it from one personally, who you choose to code for is much more of a moral choice. The programmers you will one day be looking to hire are the ones reading the tech news sites right now. And they will remember. Via Geohot

[Update 1]: Koush seems to stick with Android OS rather than moving to PS3. He commented,

To clear up any confusion, I was not offered a job, just an interview, which I declined out of principle. For those saying “I’m going to regret being principled”, etc. Probably not. Android App sales have been more than good to me. Good, enterprising, devs should never find themselves short of opportunities.

Judge in Sony vs. Geohot orders YouTube and others to give up users’ personal info

Remember when Sony sued Geohot and demanded that YouTube hand over the user info of all the folks who posted comments to Geohot’s PS3 jailbreak video? Well, score a victory for SCEA, as the judge overseeing the case’s jurisdictional discovery process has ruled that Sony can get what it wanted — information from: Bluehost (who hosts Geohot’s website) regarding who downloaded the jailbreak, Twitter regarding any tweets made by Hotz, Google Blogspot regarding comments made on his blog, and the aforementioned YouTube user data. Keep in mind that Sony’s getting this information to show that many of the downloaders and commenters are from Northern California and that Hotz’s hacking efforts were aimed at Californians — meaning the case should remain in the Bay Area instead of moving to New Jersey where Geohot hacked his PS3. With this new information at its disposal, Sony’s better equipped to oppose Hotz’s motion to dismiss in a hearing early next month, but this doesn’t mean the company will succeed in its bid to keep the litigation a West Coast affair. We’ll have to wait and see if this latest victory helps Sony win the war. Stay tuned.

Having Collected Sufficient Funds, Geohot Calls Off Donation Request

George Hotz, the “hacker” known to the world at Geohot, had recently asked for donations for a legal defense fund. You’ll recall that Sony flipped out after Geohot made the tools available for everyday people to jailbreak their PS3, which in Sony’s mind is tantamount to piracy. Anyhow, Hotz has called off the donation request, saying that he’s collected enough money to hire “a few more lawyers” for his defense.

Hotz had ostensibly released the PS3 jailbreak tools so that people can once again take advantages of the system’s abilities to run alternative operating systems. Sony removed the Install Other OS option from the PS3 last year, citing security concerns. Funny how Sony has the right to unilaterally remove your ability to use certain features (here, Other OS) while you can’t go ahead and restore that feature, or add other features. I don’t see Apple telling MacBook owners that they’re not allowed to install Microsoft Office or Chrome.

Given the glacial speed of the courts, expect this to drag on pretty much forever. Chelsea will actually win a game before this gets worked out.

Sony Wins Restraining Order Against Geohot, Updates PS3 Firmware To 3.56 In Effort To Stop Hacking

PS3 owners will be prompted to update their system to firmware version 3.56 today. Why is that? Hmm, could it possibly have something to do with Sony trying to prevent your from jailbreaking your system? Yes, obviously. (“This is a minor update that adds a security patch.”) If you update your system say goodbye to being able to hack your PS3 to pieces… for now, at least. And maybe for a good while, too, given that Sony has managed to win a restraining order against Geohot.

Not only has Sony won a temporary restraining order against Geohot, real name George Hotz, and his crew, but it looks like the case will be able to be held in San Francisco, in front of judges who haven’t been too kind to lone coder types before.

The 3.56 update was pushed out within the past few hours, so it’ll be interesting to see if A) it stops jailbreaking for good or B) will merely signify a new game of cat-and-mouse between Sony and the larger jailbreaking community. I seem to remember frequent PSP firmware updates back in the day that were designed to mitigate the effects of custom firmware, but, really, once the system was cracked it was pretty much cracked for good.

And even if you were to jailbreak your PS3, please don’t hop online and ruin everyone’s good time. Nobody likes a bully.
